MushroomVillage.com ("MV") reserves the right to change the terms and conditions of this agreement without prior notice to the user. It is the responsibility of the user to regularly review the terms of this agreement.

The bulletin board system ("Bulletin Boards") provides a means of posting messages and/or files between users. MV may or may not monitor or moderate the messages, information or files delivered to the Bulletin Boards. It is a condition of use of the Bulletin Boards at MV that users shall not:

• Post or transmit any message or materials that are not reasonably related to the purpose of the Bulletin Boards as stated in the description for each forum;
• Restrict or inhibit any other user from using and enjoying the Bulletin Boards, by means including but not limited to, the posting of harassing, annoying, inflammatory, insulting, rude, or otherwise unprofessional messages directed at any other individual, group of individuals, or entity. It is understood that users' messages express the views of the user authoring the message, not necessarily the views of MV;
• Post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane or indecent information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any local, state, national or international law;
• Post or transmit any information, software or other material which violates or infringes upon the rights of others, including material which is an invasion of privacy or publicity rights or which is protected by copyright, trademark or other proprietary right, or derivative works with respect thereto, without first obtaining permission from the owner or right holder;
• Post or transmit any message, information, software or other material that contains a virus or other harmful component; or,
• Post or transmit any messages, information, software or other material for commercial purposes not related to the description of that forum or post or transmit messages, information, software, attachments, or other materials that constitute or contain advertising for or promotion of any product or service not related to the description of that forum.

You understand that MV has no obligation to monitor the Bulletin Boards but reserves the right at all times to do so and to disclose any information as necessary to satisfy any law, regulation or governmental request, or to refuse to post or to remove any information or materials, in whole or in part, that in MV's sole discretion are objectionable or in violation of these terms and conditions. Other conditions may apply to a specific service or bulletin board and will be posted as part of that service.

Users who violate MV's terms of use may have their rights of access to the MV site withdrawn with or without prior notice at the sole discretion of MV.

Users agree to indemnify and hold MV harmless against any and all claims and expenses, including attorney's fees, related to any civil or criminal proceeding arising from their use of the Bulletin Board. This expressly includes, but is not limited to: (i) user responsibility for any and all liability arising from the violation or infringement of proprietary rights or copyrights, and (ii) any libelous or unlawful material contained within message board postings.

Users agree that any and all file uploads and messages, and the complete contents thereof, become the sole and exclusive property of MV. MV has the sole and exclusive right to modify, delete, and/or make any use whatsoever in any location and medium, of all content posted by any user to MV.

Limitation of liability

UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL MV OR ANY OF ITS SUBSIDIARIES, AGENTS OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, MV MATERIALS. YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT MV IS NOT LIABLE FOR ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF ANY USER. IF YOU ARE DISSATISFIED WITH ANY MV MATERIAL, OR WITH ANY OF THE TERMS AND CONDITIONS OF USE OF THIS SITE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE BULLETIN BOARDS.
